Mandate to sell
If you decide to entrust the objects in your possession to Gelardini Aste for sale, we will assist you during all the procedures with the utmost professionalism. Upon delivery of the lots to the Auction House, a deposit receipt will be issued with the description of the lots and the agreed reserves. Subsequently, you will be required to sign the General Conditions of Sale and the Sales Mandate, which will indicate the list of objects that will be auctioned, the reserve prices, the auction rights and all other costs that will remain at the expense of the seller: transport costs, insurance for items of singular value and any other expenses that may be necessary. In addition, you will be asked for a valid identity document and the tax code for the annotation on the Public Security registers as required by current laws and stored in our offices. Gelardini Aste is responsible for illustrations, set-up, catalog, advertising and insurance. By signing the mandate, the seller agrees, in favor of Gelardini Aste, to the use of the photographic image of the lot put up for sale. Therefore, nothing can be requested in the case of use of the photographic image in catalogs, publications, brochures, posters, advertising and the like, in any way and by anyone reproduced.
Reserve price
The reserve price is the minimum confidential price, agreed between Gelardini Aste and the principal, below which the lot cannot be sold; it can be lower, equal or higher than the estimate reported in the catalog.
It is strictly confidential, it is not disclosed by the Auctioneer at the auction and is reported only in the mandate to sell next to the description of each lot.
If the reserve price is not reached, the lot will be unsold and will be withdrawn from the auction.
Lots offered without reserve are indicated in the catalog with the wording O.L. (Offerta Libera - Free Offer) and are awarded to the highest bidder regardless of the estimates published in the catalog.
Insertion of lots in the catalog
For the goods included in the mandate to sell, if necessary and/or to improve their sale, Gelardini Aste, at its discretion, reserves the right to divide them into multiple auctions, including subsequent ones.
Before each auction, the principal will receive communication with the list of goods included in the catalog and related lot numbers. The outcome of the auction will be communicated within 10 (ten) working days from the date of the auction ending.
Settlement and payments.
After 40 working days from the end of the auction sale, Gelardini Aste will pay the amount due for the goods sold by bank check to be collected at the administrative office or by bank transfer to C/C in the name of the owner of the lots, provided that the buyer has honored the obligation assumed at the time of the award and that there have been no complaints or disputes relating to the goods awarded. At the time of payment, an invoice will be issued detailing the awards, commissions and any other expenses. In any case, the balance to the principal will be paid by Gelardini Aste only after having received the full payment from the buyer.
